Dog bites and attacks are more common than you might think. But these attacks have less to do with the breed of the dog and more to do with the dog’s owner failing to maintain control of their animal at all times.
There are a couple of different ways that you may be able to obtain the compensation you need to rebuild your life after your injuries. But when you are still recuperating from your injuries, the thought of building a case against the liable party may be intimidating.
Let a respected Utah dog bite lawyer at Craig Swapp & Associates help. With our firm by your side, you will be able to focus on healing while we work on building a powerful Utah personal injury case against the at-fault party. Continue reading to learn more about what Utah’s dog bite laws look like and the potential dog bite defenses you should prepare for.
Under Utah law, dog owners will be held strictly liable for the injuries that their pets and other animals cause. Even if a dog accidentally causes someone serious injury, the dog owner will still be held accountable for their actions. This is known as strict liability.
It doesn’t matter whether the dog has a prior history of fighting, a propensity toward aggression, or other indicators of violence. The dog owner will be responsible for covering all of the losses injury victims sustain as a result of the dog’s bite, attack, or other actions.
Just because a dog owner can be held accountable for their dog’s actions doesn’t mean they won’t try to get out of compensating you fairly. The strict liability law only applies to cases where the injured victim was not trespassing on the property of the dog owner at the time of the incident.
It also states that the dog must not have been provoked into acting aggressively. If someone were to hit, kick, punch, taunt, yell at, throw things at, or otherwise provoke the dog into biting or attacking, that party would not be able to sue the dog owner for their injuries.
The physical and emotional trauma of a dog attack is undeniable. You may not feel confident in the thought of going to court. But with a dedicated Utah dog bite lawyer at Craig Swapp & Associates by your side, you can breathe a sigh of relief.
Our legal team will do everything possible to ensure that the dog’s owner is held accountable for the actions of their dog and that you are awarded full restitution for your suffering. Before calling your firm I had 2 big worries. One was I didn’t want to do more paper work, and that fear was resolved when I had to do very little, but Craig Swapp and Assoc. did most of it, and when I did have to come in to sign papers they worked around the times I could do it. Worry 2 was I didn’t want people to think I was “sue happy” and that I was just out to get money. I just wanted my bills to be paid for that were from the accident, and that was resolved I think by Mr. Wes Mortenson and Theresa because they listened to what I had to say.
My biggest fear was not having all the expenses caused by the accident paid for in full. I was assured they would be taken care of but I admit I was skeptical. When we wrapped everything up (which happened quicker than I was originally told) I had extra money in my pocket. I honestly thought there was a catch but my attorney explained everything to me in detail. If I am ever in that position again I’ll be giving Craig Swapp a call.
I was afraid of the fees I would have to pay a lawyer. I waited over a year before hiring your law firm. I finally reached out to your online help where they were able to help me understand the process and what would happen. In all honesty I absolutely loved working with the individuals that were involved in my case. They were genuine & heartfelt about my case. It felt as though they really cared and were concerned about me, not just as a client but as a person.
I was afraid that my issue was too small to be handled, and that it would just be rejected. Or that I’d end up having to pay for my medical expenses and any of your teams expenses. I would definitely answer yes, it was resolved! I wasn’t ever made out to feel like my little issue didn’t matter, and my expenses were paid for- just what I wanted/needed.
My biggest fear was that it would be pointless to pursue legal action in my case. I felt like maybe I didn’t have much of a case. After speaking with Paul, I realize it was not of my own fault and that others can be held responsible for the pain and suffering I went through.
