Will Bankruptcy Eliminate Payroll Taxes?

No bankruptcy will not discharge any payroll taxes that you owe, however, there is one caveat. If your business owes the payroll taxes, you would still be liable for those taxes after the bankruptcy discharge. If your business does not have the means to pay the payroll taxes, the IRS may file a proof of claim against you personally and come after the funds directly. However, you may be able to pay those taxes through your Chapter 13 plan if you file personally and get those debts covered by your Chapter 13.
