Landmark Utah Supreme Court Case won by Craig Swapp and Associates

Utah Supreme Court Landmark Ruling Limits Physician Regulation

The Utah Supreme Court ruled 5-0 on March 15th, 2011, that treating physicians cannot be compelled to submit detailed expert reports as part of litigation associated with their injured patients. In addition, the court found that physicians will now be able to testify to what event caused the injury. The Court’s unanimous decision in the R. Alan Drew vs. Tonia Mann Lee case overturned several lower court decisions that said rules for paid expert witnesses hired by insurance companies must also apply to treating physicians.

Attorney Roger W. Griffin of Craig Swapp & Associates successfully argued for the change before the Utah Supreme Court. Said Griffin, “The insurance industry should not be able to limit the role of the treating physicians when testifying on behalf of their patients injured by another’s negligence.”
Griffin also noted the decision will streamline personal injury cases, “This
decision will expedite cases through the court system, which will maintain or even lower costs.”

Attorneys representing the insurance industry unsuccessfully argued that treating physicians should be treated as expert witnesses and be forced to submit lengthy reports to explain their treatment of the patient. Such  requirements would result in higher expenses and court delays. “Our position is that doctors should spend time treating their patients rather than writing detailed expert reports,” said Griffin.

Griffin was assisted in his petition to the Utah Supreme Court by Attorney Ryan Springer of the Utah Association For Justice, who drafted the Amicus Brief, and Attorney Frank Carney who submitted his original paper on the “Role of Treating Physicians.”

Craig Swapp & AssociatesSANDY, UT – Managing Partner Craig Swapp announces Gregory & Swapp will now do business as Craig Swapp & Associates, effective today.

As part of this brand shift, the law firm is adopting a new tagline, ‘One Call for Justice” to better reflect its commitment to meet clients’ legal needs.  The new name and tagline will be featured prominently in the firm’s new television, radio and print campaign, which launches in September.

Managing Partner and firm spokesperson Craig Swapp explains, “Over the years, we’ve seen some market confusion with the similarity between the name of the firm and my name as chief spokesperson for the firm.  We decided the launch of a new marketing campaign would be an ideal time to make the name change and remove any confusion.”

A featured element in the new marketing campaign is the ‘One Call for Justice’ tagline, which replaces the well-known ‘One Call, That’s All.’

“While ‘One Call, That’s All’ was memorable, it failed to capture completely what our law firm was all about,” says Swapp.  “The new tagline places an emphasis on our clients seeking and receiving justice – which is the foundation of our legal system.”

“Although Buddy will no longer be involved with the day-to-day operations of the law firm, as an emeritus partner, we look forward to his continued counsel concerning the future and direction of our practice,” says Craig Swapp.  “We wish Buddy well as he looks forward to spending more time relaxing with his family after a successful and distinguished legal career.”
